1. Acceptance of Terms:
By engaging in business with MotoMonk Inc., including using our website and services, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

2. Services Offered:
a. MotoMonk Inc., provides engine building and machine shop services for racing and motorsports applications.
b. Services may include, but are not limited to, engine assembly, machine work, customization, and performance tuning.

3. Pricing and Quotes:
a. All pricing provided is an estimate and is subject to change based on the specifics of the project, including additional requirements, customizations, or unforeseen circumstances.
b. Quotes provided by MotoMonk Inc. are valid for a specified period and may be subject to revision after this period.

4. Payments:
a. Payment terms will be outlined in the invoice provided by MotoMonk Inc..
b. A non-refundable deposit is required to secure services. No refund of the deposit will be issued.
c. Failure to make timely payments may result in the suspension of services or termination of the project.
d. If payment is not received within 5 days of due date, a late fee of 5% per Day plus TAX will be added to the final invoice.

5. Cancellations:
a. All cancellations must be submitted in writing (email is acceptable). Approved projects canceled by the customer are subject to a cancellation fee of $100 or 15% of the estimated total, whichever is greater.
b. Deposits are non-refundable. If special parts have already been ordered or labor has been performed, additional charges may apply.

6. No Warranty and Liability:
a. All services provided by MotoMonk Inc. are sold "as-is" with no warranty, express or implied, including but not limited to any warranty of merchantability or fitness for a particular purpose.
b. MotoMonk Inc. shall not be liable for any damages and injuries, direct or indirect, arising from the use of its services, including but not limited to loss of profits, business interruption, or loss of data.

7. Customer Responsibilities:
a. Customers are responsible for providing accurate and complete information about their project requirements.
b. MotoMonk Inc. is not responsible for the performance or reliability of third party parts or components.

8. Confidentiality:
a. MotoMonk Inc. will treat all customer information and project details as confidential.
b. MotoMonk Inc. may use customer project details for promotional purposes with explicit customer consent.

9. Governing Law:
These Terms and Conditions are governed by and construed in accordance with the laws of United States. Any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts in the United States.

​11. Liability for Lost Packages

Liability for Lost Packages: Our company will not be held responsible for any packages that are lost, stolen, or damaged after they have been shipped and are in the possession of the carrier. Once the package has been handed over to the shipping carrier, the responsibility for the package's safety and delivery lies with the carrier.

Shipping Insurance: We recommend that customers purchase shipping insurance if they are concerned about the possibility of loss or damage. Insurance provides protection for the value of the package and offers peace of mind during transit.

Carrier Claims: In the event of a lost or damaged package, customers should file a claim directly with the shipping carrier. We are unable to process claims or reimbursements for packages that are not covered by insurance.

Proof of Shipment: We will provide proof of shipment upon request, which can be used to support any claims filed with the carrier.

Customer Responsibility: It is the customer's responsibility to ensure that the shipping address provided is accurate and complete. We are not liable for any errors or omissions in the shipping address that may result in lost or undelivered packages.

12. Parts Delay:
In the event that a customer provides an engine for rebuild and intends to supply the necessary parts, we require that all parts be received within 10 days from the date of the engine drop-off. If the parts are not received within 10 days, we reserve the right to proceed with ordering the parts from our own suppliers to ensure timely completion of the engine rebuild. After 10 days of notice, if the customer has not provided the parts, we will move forward with sourcing the parts ourselves, in order to expedite the rebuild process. The customer will be responsible for the costs of the parts ordered by us, and any additional delays will be communicated promptly.

13. Full Labor Payment Required Upfront When Parts Are Provided by Customer:
When parts are provided by the customer, we do not charge any additional fees, setting us apart from other competitors. However, we reserve the right to charge the full amount for labor upfront to ensure the timely processing of your order. This policy helps us maintain efficient operations and ensures that we can allocate resources effectively to complete your rebuild.

14. Storage Fees:
Completed items must be picked up or arrangements made for return shipping within 7 calendar days of notice of completion. After this grace period, a storage fee of $25 per week (or any part thereof) will apply. Storage fees will continue to accrue until the item is collected or shipped. We are not responsible for damage or loss resulting from extended storage beyond the grace period.
